Terms of Service for Binder Bucket

Welcome to Binder Bucket, a software-as-a-service (SaaS) application provided by Binder Bucket Inc., located in Katy, Texas, USA. These Terms of Service (“Terms”) govern your use of our website at https://binderbucket.com and our SaaS application (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Eligibility
- You must be at least 18 years old to use the Service. If you are under 18, you must have parental consent.
- The Service is intended for personal or business use in accordance with these Terms.
2. Use of the Service
- Permitted Use: You may use Binder Bucket to upload scanned files for AI-powered profiling, manage your account, and organize content within your tenant (organization).
- Prohibited Use: You may not:
- Use the Service for any illegal, harmful, or unauthorized purpose.
- Upload content that violates intellectual property, privacy, or other rights.
- Attempt to hack, disrupt, or misuse the Service, including its Azure-hosted infrastructure.
- Use the Service in any way not intended by Binder Bucket Inc.
3. Accounts
- To access certain features, you must create an account with accurate information (e.g., First Name, Last Name, Email, Profile Picture, Organization Name).
- You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- We may suspend or terminate your account if you provide inaccurate information or violate these Terms.
4. Content Ownership and Storage
- Your Content: You retain ownership of all content you upload to the Service. Content is stored in encrypted form using Azure File Service Blobs and secured with encryption keys managed by Azure Key Vault.
- License to Binder Bucket: By uploading content, you grant Binder Bucket Inc. a worldwide, non-exclusive, royalty-free license to use, store, and process your content to provide the Service, including AI-powered profiling via Azure’s OpenAI instance.
- Security: We use Azure’s secure infrastructure, including Azure’s OpenAI instance, to process your data safely, avoiding reliance on less secure, direct LLM integrations.

5. Payments and Refunds
- The Service requires payment for certain features, processed securely through Stripe’s third-party payment portal.
- Refunds are available within 5 days of purchase if you request account deletion and destruction of all associated content. Contact us at [email protected] to initiate a refund.
6. Intellectual Property
- Binder Bucket Inc. owns all rights to the Service, including its design, code, and branding. You may not copy, modify, or distribute any part of the Service without permission.
- You may not use our trademarks, logos, or other proprietary materials without written consent.
7. Third-Party Services
- The Service integrates with third-party providers, including Stripe for payments, Azure for hosting and AI processing, and MongoDB for data storage. These providers have their own terms and privacy policies.
- We are not responsible for the content, practices, or availability of third-party services.
8. Termination
- You may stop using the Service at any time. To delete your account and content, submit a request to [email protected].
- We may suspend or terminate your access if you violate these Terms or engage in activities that harm the Service.
9. Limitation of Liability
- The Service is provided “as is” without warranties of any kind, express or implied.
- Binder Bucket Inc. is not liable for any damages arising from your use of the Service, except where required by applicable law.
- Our liability is limited to the amount you paid for the Service in the preceding 12 months.
10. Governing Law
- These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles.
- Any disputes will be resolved in the courts of Katy, Texas.
11. Changes to These Terms
- We may update these Terms at any time. Significant changes will be communicated via email or a notice on our website.
- Continued use of the Service after changes constitutes acceptance of the updated Terms.
